General Terms and Conditions

Effective Date: January 1, 2026

These General Terms and Conditions govern the agreement between Richard Gonyou Enterprises (operating as Landscapia) (“Contractor,” “we,” “us”) and you (“Client”). By accepting a quote or commissioning services from Landscapia, you agree to the following terms.

1. Scope of Work

All work performed is limited strictly to the scope outlined in the approved quote or contract. Any additional services, modifications, or changes requested after the project has commenced constitute a “Change Order” and may require a separate written agreement and additional fees.

2. Quotations and Acceptance

  • Validity: Quotations are valid for 30 days from the date of issuance.
  • Acceptance: By signing or accepting a quote via email or through our online booking system, you acknowledge and agree to these Terms and Conditions.

3. Payment Terms

  • Invoicing: Payments are due upon receipt of invoice.
  • Methods: We accept payment via cheque, eTransfer or Direct Payment.
  • Late Payments: Overdue accounts may be subject to an interest charge of 2% per month on the outstanding balance.
  • Deposits: For larger installations, a 40% deposit is required to secure your spot in our schedule. Work will not commence until the deposit is received.

4. Scheduling and Delays

  • Flexibility: We strive to maintain our schedule, but we reserve the right to reschedule work due to inclement weather, equipment failure, or unforeseen circumstances beyond our control.
  • Access: The Client must ensure our crew has clear, safe access to the work site on scheduled days.

5. On-Site Conduct and Safety

  • Safety: Please keep pets and children clear of work areas while our team is operating power equipment.
  • Direction: To ensure efficiency and safety, please direct all questions or requests to the owner (Richard Gonyou) rather than individual crew members on-site.

6. Materials and Liability

  • Responsibility: Once materials are delivered to the site, they are the responsibility of the Client. Landscapia is not liable for theft, vandalism, or damage caused by third parties after delivery.
  • Warranty: We provide a 30-day warranty on plant material installation, provided the Client follows the provided watering and care instructions. This warranty does not cover issues resulting from neglect, severe weather, or acts of God.

7. Termination

Either party may terminate this agreement with 30 days written notice. In the event of termination, the Client is responsible for payment for all labor performed and materials supplied up to the date of termination.

8. Promotion and Media

Landscapia reserves the right to use photographs or videos of completed projects for promotional purposes, including our website and social media, unless the Client explicitly requests otherwise in writing.

9. Governing Law

This agreement is governed by the laws of the Province of British Columbia. Any disputes arising from this agreement shall be settled through negotiation, or, if necessary, within the jurisdiction of the courts in Vancouver, BC.
